In these terms and conditions, we, our, us refers to Lively Professional Services Ltd. As we can accept your order and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure they contain all that you want and nothing that you are not happy with. We agree to provide a report with reasonable care and our experience as to the visible standards within the property at the time of the inspection. We will aim to supply the report to the customer subject to these terms and conditions, and the customer accepts these terms and conditions when placing the order.
These terms and Conditions will apply to the purchase of the services by you the customer. These are the terms on which we sell our services to you. By ordering these services you agree to be bound by these terms and conditions. You can only purchase these from the Web Site if you are eligible to enter into a contract and are at least 18 years of age.
Lively Professional Services reserve the right to change any part of this agreement without prior notice.
The inspection is not a structural or valuation survey.
The areas that we do not cover/ inspect are highlighted within our web page. Lively Professional Services cannot guarantee that they will be free from defects. By reading these you agree to be bound by these terms and conditions.
We endeavor to produce the report with reasonable skill and experience on the quality of workmanship against industry standards (NHBC). Other warranty providers may differ from the NHBC standard.
The information within the report is purely a visual inspection at the time of our visit.
Please note we do not carry out any invasive inspections.
The information within the report is provided in good faith and can only be held as our opinion, we cannot be held responsible for any inaccuracies or omissions within the report and reflects only what is available to us on the day of inspection.
Our inspectors will endeavour too but may not find all latent defects or any future defects that may appear within the property.
The inspection will cover the exterior, interior of the property including garages, drives, pathways, garden areas and fencing.
We agree to supply the client with the report subject to these terms and conditions via email no later than 48 hours after the inspection has been carried out.
We will not be held responsible if the builder fails to rectify any of the defects identified within the report.
Payment
The fees for the services or other charges will be agreed at the date we accept the order or such other price we may agree in writing.
VAT or other expenses are not incurred unless otherwise specified.
Payment is due in full by credit/debit or BACS upon receipt of your report. Payment made via PayPal or credit cards will be subject to a 3.5% surcharge to cover transaction expenses.
The Client agrees to pay the agreed price to us when the order is placed, by placing this order you agree to our Term and Conditions.
If the Customer fails to make payment due to us by the payment date, the Customer shall pay interest on the overdue sum from the due date until payment of the overdue sum, interest will accrue each day at 4%. If the property is found to be larger than the booking states, the Customer agrees for us to amend the invoice accordingly.
Our inspector will endeavour to arrive at the property on time, however we cannot be held responsible for being late due to traffic or other unforeseen circumstances.
Where our inspector is unable to gain access or refused access by the site on the date of the survey a rearrangement fee of 50% of the agreed price is to be paid. Where we fail to ensure access, there will be no costs to the client.
Should the client wish to cancel the inspection they can do so at any time 24 hours before without giving any reason or incurring any fee.
Lively Professional Services Ltd reserve the right to terminate the contract at any time, however this agreement will be governed by the laws of England.
All written and oral information disclosed or provided by the client under these terms and conditions is confidential information regardless of how it was provided
We agree that we will not disclose, divulge, reveal, report, or use for any purpose, any confidential information which we have obtained except as authorised by the client or as required by law
